Announcement of the Maritime Safety Administration of the People's Republic of China on the implementation of the International Code for the Safety of Ships Carrying Industrial Personnel
The International Maritime Organization (IMO) International Code for the Safety of Ships Carrying Industrial Personnel (Resolution MSC.527 (106)) (hereinafter referred to as the "IP Code"), which entered into force on 1 July 2024, hereby announces the following matters for the effective implementation of the IP Code:
Requirements for ship inspection and certification
Scope of application: 500 gross tons and above, carrying more than 12 industrial personnel of international navigation ships. For applicable ships, ship inspection institutions shall carry out inspections in accordance with the relevant requirements of the Statutory Technical Regulations for Inspection of International Sailing Vessels, and issue Industrial Personnel Safety Certificates and Equipment Records if they pass the inspections.
Second, industrial personnel requirements
(1) Industrial personnel means persons carried on board ships for the purpose of carrying out industrial activities at sea on other ships or offshore installations.
(2) The master of a ship carrying industrial personnel shall ensure that the industrial personnel carried comply with the following requirements:
1. At least 16 years old.
2. Hold a valid Certificate of Basic Safety Training for Seafarers or Certificate of Qualification for Maritime Traffic Safety Skills Training for Staff of offshore Facilities (at least complete basic training);
(3) Hold a valid seagoing ship Crew Health Certificate that meets the health requirements of service and other seagoing positions, or a health certificate recognized by the owner unit of the Marine industrial activities in which they are engaged;
4. Be familiar with the main working language of the ship or crew on board.
(3) Before the ship sets sail, the master shall organize industrial personnel to conduct at least the following training and keep the corresponding training records:
1. Familiar with the training, including but not limited to: the general arrangement of the ship, personal life-saving equipment, assembly and boarding points, emergency escape routes, and the location of first aid stations;
2. Emergency training, including but not limited to: safety information, symbols, signs and alarms on board, alarm sounding or action to be taken in case of emergency;
3. Maritime personnel transfer training, including but not limited to: ship's maritime personnel transfer procedures, arrangements, and related safety equipment and measures.
Special training requirements for the crew of ships carrying industrial personnel
The crew of the ship carrying industrial personnel shall complete the training of "Passenger Ship Crew Special Training Certificate I" or "Passenger Ship Crew Special Training Certificate II" in the seagoing ship crew training institution with the passenger ship crew special training program, and have the corresponding training certificate issued by the training institution.
5. Safety management requirements for shipping industry personnel and ship managers
(1) The ship manager shall formulate a safety management system for industrial personnel on board, specify the scope of activities and safety precautions for industrial personnel on board, and take measures to prevent industrial personnel from entering dangerous places or places that may affect the safe operation of crew members.
(2) The ship manager shall formulate procedures for the transfer of industrial personnel on and off the ship at sea, and train the crew of the ship carrying industrial personnel on safety precautions for the transfer of industrial personnel at sea. Before the transfer of personnel at sea, the captain or the relevant responsible personnel shall check the weather, sea conditions, visibility, communication and safety equipment and life jackets worn by personnel to ensure that the conditions for the safe transfer of personnel are met. It is prohibited to transfer personnel at sea in bad weather or sea conditions.
(3) The ship manager shall formulate an emergency plan for industrial personnel to ensure timely response to such emergencies as personnel falling into the water, sudden serious illness, injury or mass incident during the process of transportation or transfer.
(4) Before the ship sets sail, the ship manager shall accurately grasp the number and correct identity information of the industrial personnel to be carried, and the master or the relevant responsible personnel shall verify the actual situation of the transport, ensure that the total number of people on board the ship approved does not exceed the number of people signed on the Equipment Record, and truthfully submit the relevant information to the maritime administrative authority through the ship entry and exit report system.
Requirements for safe navigation of ships
(1) Before the ship sets sail, the master or the relevant responsible personnel shall inspect the conditions and relevant certification materials of the industrial personnel, carry out pre-boarding safety inspection of the industrial personnel and the articles carried by them, record the inspection situation and keep it on the ship for inspection by the maritime administrative authority.
(b) If dangerous goods are carried, the additional requirements of Part IV and V of the IP Rules shall be met.
7. Maritime safety supervision requirements
(1) The maritime administrative authority shall strengthen the supervision and inspection of the technical conditions and inspection certificates of the ships carrying industrial personnel, the qualification certificates and training records of the crew and industrial personnel, the carriage of goods and personnel and the management of the ships.
(2) The maritime administrative agency shall carry out the verification of the establishment and implementation of the relevant systems and systems of the shipping company through the review of the safety and pollution prevention management system of the shipping company and the supervision and inspection of the company.
(3) In the course of supervision and inspection, the maritime administrative agency finds that the shipping company or the ship, crew and industrial personnel are not satisfied with the requirements of this notice, it shall order them to rectify. If the circumstances are serious, measures such as prohibiting the ship from leaving the port, additional audit by the company, maritime administrative penalties shall be taken according to law.
